These terms govern your use of thefurnituregalatampa.com and your purchases from Ty Furniture Guy LLC, doing business as The Furniture Gala ("we," "us," or "our"), located at 7220 N Dale Mabry Hwy, Tampa, FL 33614. By using this website or purchasing from us, you agree to these terms.
1. About us
The Furniture Gala is a furniture retailer serving the Tampa Bay area. We sell living room, bedroom, dining, mattress and decor furnishings, and we offer special orders, layaway, financing and local delivery.
2. Pricing and availability
- Prices are subject to change without notice. The price in effect when your order is written is the price that applies.
- Showroom inventory is limited. Availability is not guaranteed until your order is written and paid or deposited.
- If a product or price is listed incorrectly on our website or in an advertisement, we reserve the right to correct the error and to cancel any order placed at the incorrect price, with a full refund of amounts paid on that order.
- Photographs are representative. Fabric, finish and colour may vary slightly from what appears on a screen.
3. Orders, deposits and special orders
- All orders are documented on a written invoice.
- A deposit is required to place a special order. Special orders are placed with the manufacturer specifically for you and cannot be cancelled once submitted.
- Balances must be paid in full before merchandise is delivered or picked up.
- Lead times quoted for special orders are estimates provided by the manufacturer and are not guaranteed.
4. All sales are final
Please inspect your merchandise before you sign for it, and note any problem on the delivery paperwork before our crew leaves. Damage or defects discovered after delivery paperwork is signed are handled under the manufacturer's warranty, described in Section 7.
5. Delivery
Delivery is charged separately from merchandise and is due before the truck goes out.
Delivery rates by distance from our store
- Up to 10 miles — $99 delivery only, $199 with setup
- 11 to 20 miles — $149 delivery only, $249 with setup
- 21 to 30 miles — $199 delivery only, $299 with setup
- 31 to 40 miles — $249 delivery only, $349 with setup
- Over 40 miles — quoted by management
Floor surcharge. Each floor above the first adds $75.
Delivery and assembly are separate charges. If you choose drop-off only, our crew will not assemble anything. Assembly can be added only if you notify us at least 48 hours before your scheduled delivery and pay the difference in advance.
Delivery days and windows. Deliveries run Monday through Saturday, 11:00 am to 8:00 pm. We provide a delivery window, not an exact time. No delivery date or window is confirmed until we confirm it back to you.
Your responsibilities
- The delivery area must be completely cleared before our crew arrives. Our crew does not move, remove or haul away existing furniture, and does not connect or disconnect electronics or appliances.
- Someone 18 years or older must be present for the entire delivery window to accept and sign for the delivery.
- You are responsible for confirming that your merchandise will fit through your doorways, hallways, stairwells, turns and elevator.
- If no one is available, the address or access is different than described, or the area is not cleared, the delivery will be refused and a redelivery fee will apply.
Customer pick-up
Wrapping for pick-up is optional and is charged per item: from $30 for small items, $50 for a dresser, nightstand or mirror, and from $100 for large pieces. Merchandise taken unwrapped travels as-is.
6. Financing and lease-to-own
We offer referrals to third-party financing and lease-to-own providers, including credit-based financing and no-credit-needed lease-to-own options. These are separate companies. Your application, approval, agreement and payments are between you and that provider, and are governed by their terms and their privacy policy. We are not a lender and do not make credit decisions. All financing is subject to approval. With lease-to-own, paying over the full term costs more than the cash price; early purchase options are available.
7. Warranties
We do not provide our own warranty on merchandise. Products are covered by the manufacturer's warranty, if any, on the terms that manufacturer offers. We will assist you in submitting a manufacturer warranty claim.
Clearance, floor model and as-is merchandise is sold in its current condition with no warranty of any kind, express or implied, to the fullest extent permitted by law.
8. Text messages
If you provide your phone number and consent to receive text messages, you agree to receive messages from The Furniture Gala at that number, including messages sent using an automatic telephone dialing system. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Consent is not a condition of purchase. See our Privacy Policy for full details.
9. Website use and intellectual property
All content on this website — including photography, images, logos, text and design — is the property of Ty Furniture Guy LLC and is protected by copyright and trademark law. You may not reproduce, distribute or use any of it for commercial purposes without our written permission.
You agree not to use this website to transmit unlawful, harassing or harmful content, or to attempt to gain unauthorised access to our systems.
10. Limitation of liability
To the fullest extent permitted by Florida law, our total liability arising out of any purchase or your use of this website is limited to the amount you paid for the merchandise or service at issue. We are not liable for indirect, incidental, consequential or punitive damages. Nothing in these terms limits any right you have that cannot be waived under applicable law.
11. Governing law and disputes
These terms are governed by the laws of the State of Florida. Any dispute arising out of these terms or your purchase is subject to the exclusive jurisdiction of the state and federal courts located in Hillsborough County, Florida.
12. Changes to these terms
We may update these terms at any time. The current version is always posted on this page with the effective date above. The terms in effect on the date of your purchase govern that purchase.
